On January 26, Shanghai Intellectual Property Court accepted the first case involved in the free trade zone. The plaintiff, Xuyue (Beijing) Sci. & Tech. Co., Ltd., alleged that it applied a utility model patent called “ion-selective electrode device” at the State Intellectual Property Office on November 29, 2006 and the patent was publicized on February 20, 2008; and has been paying an annual fee till now after getting the utility model patent. Ltd. Located in China (Shanghai) Pilot Free Trade Zone, the defendant Shanghai Equshine Scientific Instruments Co., Ltd. infringed utility model patent products of Xuyue (Beijing) Sci. &Tech. Co., Ltd. by importing, selling and offering for sale for the purpose of production and management without permission, resulting in decrease in sales volume in a short time and causing huge economic losses to the Xuyue (Beijing) Sci. &Tech. Co., Ltd. Whereby, Xuyue (Beijing) Sci. &Tech. Co., Ltd. requested the Court to order the defendant to stop the infringement act, to compensate for the economic loss, and to assume all legal costs. The case is on trial at the Court.
