On the morning of March 4th, Shanghai No.3 Intermediate People's Court (Intellectual Property Court, Railway Transportation Intermediate Court) held a Central Team Party Leadership Group and Judicial Committee (Extended) learning workshop and invited Mr. Lv Guoqiang, Director of Shanghai Intellectual Property Administration, to interpret the Implementation Opinions on Strengthening the Application of Intellectual Property Rights and Protecting and Supporting the Construction of Science and Technology Innovation Center (hereinafter Implementation Opinions) issued by Shanghai CPC Committee and Shanghai Municipal People's Government. The workshop was hosted by Mr. Wu Xielin, Secretary of the Party Leadership Group and President of Shanghai No. 3 Intermediate People's Court, and attended by leaders including Ni Chunnan, Li Shulan, Qu Furong and Wang Renyan. The attendants also included the leaders of various departments, all officials and police officers of IP tribunal and Criminal Tribunal, and members of Sanwei Society, totaling over 40 officials and police officers. Director Lv Guoqiang interpreted the formulation background, basic frame and specific measures of Implementation Opinions in-depth from the aspect of the targets and tasks of work on the intellectual property rights, and communicated with the officials and police officers. President Wu Xielin made four requests on the implementing the Implementation Opinions. Firstly, we should further study and comprehend, and strengthen the sense of responsibility and mission to serve and guarantee the construction of the science and technology innovation center. The Article I of the Implementation Opinions specifies the judicial protection of intellectual property rights, fully showing the importance of judicial protection for the work of intellectual property rights. We should further study and comprehend, and work hard to have a thorough understanding by referring to File No. 71 of State Council and the 22 Opinions on Construction of Shanghai Science and Technology Innovation Center, and put our thinking and action into major decision-makings, arrangements and work requirements of Shanghai CPC Committee and Shanghai Municipal People's Government. Secondly, we should further strengthen overall situation consciousness, and create a sound legal environment to serve and guarantee the construction of the science and technology innovation center. We should refer to the 26 opinions on serving the construction of science and technology innovation center by the intellectual property court, refine and implement the requirements concerning judicial work in the Implementation Opinions, further strengthen the consciousness to serve the overall situation, further innovate and improve the ways and methods for serving the overall situation, fully take advantage of the resource and system advantages of concentrating the trial of intellectual property cases in the court, and raise the level and effect of serving the overall situation. Thirdly, we should further strengthen the judicial protection, and improve the judicial credibility of Shanghai Intellectual Property Court. We should actively respond to the requirements on judicial protection of intellectual property rights, overcome difficulties and fix the weakness in judicial protection of intellectual property rights, strengthen study on trial mechanisms, methods and principles, attach great importance to the trial of intellectual property right cases, and strictly implement judicial protection of intellectual property rights by focusing on the effectiveness, quality and results of intellectual property right protection. Fourthly, we should further deepen the mechanism and system reform to manifest the dominant role of judicial protection of the intellectual property court. we should refer to the three-year plan of Shanghai Intellectual Property Right Court, accelerate the implementation of the relevant reform tasks provided in the Implementation Opinions, further give full play to the advantage of the "2+1" trial mechanism to reflect the "three-in-one" trial results. We should also establish a mechanism that connects law enforcement with justice to display concerted efforts in protecting intellectual property rights and strengthen the construction of a diversified mechanism for resolving disputes over intellectual property rights to embody the social effect of justice in safeguarding the social stability and resolving disputes, and manifest the dominant role of justice in protecting the intellectual property rights.
