On April 8th, the Plaintiff Mr. Pan filed a lawsuit to Shanghai Intellectual Property Court against a company in Suzhou and a company in Shenzhen for the dispute over computer software copyright transfer contract and website domain name transfer contract, requesting for a judgment that the Defendants return RMB 48,000 to the Plaintiff. After receiving the case materials, the Court asked both parties whether they would like to have a pre-litigation mediation according to the pre-litigation mediation procedures. The Plaintiff hoped to resolve the dispute as soon as possible, so he agreed the mediation. Afterwards, the staff of the case filing tribunal called the Defendants, made inquiries, fully explained the regulations and reasons, analyzed the cost possibly incurred in the litigation and advised mediation with the Plaintiff. On April 13th, the Plaintiff called the Court and informed that the Defendants had returned RMB 48,000 as the Plaintiff requested, so the Plaintiff agreed to withdraw the lawsuit. After verifying the related situations with the Plaintiff face to face the next day, the case filing tribunal delivered the order allowing withdrawal of the lawsuit on the spot. The case only took a week from the Court receiving the litigation materials, meditating by call and making payment to the final resolution. For the purpose of appreciating the Court’s timely and efficient resolution of the dispute, the Plaintiff sent the court a silk banner of “Authoritative and Efficient Pre-litigation for Convenience and Justice” to the case filing tribunal, as well as a letter of thanks to appreciate the spirit of the case filing tribunal staff of “concern what the people concern, and satisfy what the people need”.
